  1. Refund Eligibility

We offer refunds under the following circumstances:

2.1 Service Disruption: If the Service experiences significant downtime or technical issues due to server malfunction only, that impede your ability to use it for an extended period of more than 24 hours, you may be eligible for a refund. Otherwise, you may inform us through an email at enquiries@bestracksys.com for us to rectify the technical issues.

2.2 Cancellation within the Trial Period: If you cancel your subscription within the initial trial period, no charge will be incurred.

2.3 Dissatisfaction with the Service: If you are not satisfied with the Service within the first 30 days of your subscription, you may request a refund. Refund eligibility may vary by cases, in which Bestrack  may take some time to review and process the User’s request. The remaining subscription will be paid pro-rated and with a deduction of handling fee (15% of monthly subscription fee).

  1. Refund Request Procedure

To request a refund, you must follow these steps:

3.1 Contact Support: Contact our customer support team at enquiries@bestracksys.com within the specified time frame, explaining the reason for your refund request.

3.2 Provide Information: Include the following information in your refund request:

– Your full name

– Your company name

– Email address associated with your account

– Date of purchase

– Transaction ID or receipt

– Your bank account details.

3.3 Evaluation: Our customer support team will evaluate your request and respond to you within 7-10 business days (Monday-Friday).

  1. Refund Process

If your refund request is approved, we will process the refund in the following manner:

4.1 Refund Method: Refunds will be issued to the provided and authorized bank account by way of Telegraphic Transfer (TT) or by way of cheque.

4.2 Refund Period: Refunds may take up to 14 business days to be processed, depending on your payment provider.

  1. Exclusions

The following situations are not eligible for refunds:

5.1 Violation of Terms: If you violate our Terms of Service including, but not limited to phishing, impersonation, fraud, and violation of any applicable laws, you will not be eligible for a refund.

5.2 Third-Party Fees: We are not responsible for any fees charged by third-party payment providers or banks. The User acknowledges and agrees that the Company does not endorse or recommend, is not an agent, reseller or distributor of, and has no control over any products or services advertised on the Site through the Services, and the Company hereby expressly disclaims all liabilities and responsibilities arising in relation to any products or services whether available or advertised via the Site through the Services.

5.3: Exclusion of Liabilities:

To the full extent allowed by applicable law, in no event shall the Company, its parent company, subsidiaries, associated companies, directors, officers, employees, servants, suppliers, agents or assigns, shall be liable under any circumstances for:

(a) any punitive, incidental, indirect or consequential damages and/or losses related to this agreement including economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings);

(b) any loss of goodwill or reputation;

(c) any special, indirect or consequential damage arising out of or in connection with this Agreement, including but not limited to actions for breach of contract, actions under the tort of negligence, defamation, copyright infringement, trade mark infringement, passing-off, infringement of registered industrial designs, patent infringement, breach of confidence;

(d) any liability at common law; or

(e) in any other way.

Subject to the limitation stated above, nothing in this Agreement shall be deemed to limit or exclude the Company’s liability for fraudulent misrepresentation, or for death or personal injury resulting from the Company’s negligence or the negligence of the Company’s servants, agents or employees.

For avoidance of doubt, the Company is not liable and shall not be liable for the acts or omissions of other providers of telecommunications services or for faults in or failure of their networks and equipment.

5.4: Indemnity:

The User at all times agrees and undertakes to indemnify, hold harmless and defend the Company, its parent company, subsidiaries, associated companies, directors, officers, employees, servants, suppliers, agents or assigns from any actions, claim, demand, proceedings, costs, liabilities and expenses (including reasonable legal fees and disbursements) sustained, incurred or paid by the Company directly or indirectly, due to or arising out of the User’s breach of this Agreement (including the documents incorporated by reference), or arising out of the User’s violation of any law or the rights of a third party.

  1. Changes to this Policy

We reserve the right to amend or update this refund policy at any time. Any changes will be effective immediately upon posting the updated policy on our website.
